Terms & Conditions

By creating a profile, posting a request, or otherwise using the FillXI website or mobile apps (the “Service”), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the Service.

FillXI is currently offered as a free early-access pilot for community cricket in New Zealand and Australia.

FillXI is an introduction platform. We help players, teams and clubs find each other and put them in touch. We are not a club, association, employer, agent, or competition organiser.

We do not select teams, arrange fixtures, verify playing ability, run background checks, supervise training or matches, or take part in any agreement you reach with another user. Any arrangement — including playing commitments, fees, subs, transport and club registration — is solely between you and the other party.

• You must be at least 16 years old to create an account.
• You must provide accurate information and keep your profile, availability and contact details up to date.
• You are responsible for keeping your password secure and for activity under your account.
• If you register on behalf of a team or club, you confirm you are authorised to do so and to share the details you enter.

You agree not to:

• post false, misleading or impersonating information;
• harass, bully, discriminate against, or send unsolicited commercial messages to other users;
• scrape, bulk-collect, republish or resell player, team or club information from the Service;
• use another person’s contact details for any purpose other than the cricket connection they were shared for;
• attempt to bypass security, rate limits, access controls or authentication on the Service.

Sending commercial electronic messages through or as a result of the Service must comply with the Unsolicited Electronic Messages Act 2007.

Contact details revealed to you after an accepted application or invitation are provided for the purpose of arranging cricket only. You must handle them consistently with the Privacy Act 2020, not add them to marketing lists, and not pass them on to anyone else without consent.

Clubs, teams and captains remain responsible for their own registration, safeguarding, health and safety, insurance and vetting obligations, including any Children’s Act 2014 safety checking requirements where they apply. Players are responsible for satisfying themselves about the team or club they join. FillXI does not perform these checks on anyone’s behalf.

You keep ownership of the information and content you submit. You grant FillXI a non-exclusive licence to host, display and share it as needed to operate the Service (for example showing your listing to relevant clubs or players). We may remove content that breaches these terms.

The Service is provided during a pilot and may change, be interrupted, or be withdrawn. We aim to keep it available and accurate but we do not guarantee uninterrupted access, that any player will be found, or that any request will be filled.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand law that cannot lawfully be excluded.

Where you use the Service for business purposes, you agree that the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, and that this exclusion is fair and reasonable.

To the extent permitted by law, FillXI is not liable for any indirect or consequential loss, loss of opportunity, or loss arising from the conduct of another user, from cancelled or unfilled matches, or from injury sustained while playing cricket. Our total liability in connection with the Service is limited to NZ$100 or the amount you have paid us in the previous 12 months, whichever is greater.

You can stop using FillXI and delete your profile at any time. We may suspend or remove an account that breaches these terms, misuses other users’ details, or presents a risk to the community. On deletion, your profile and related records are removed as described in our Privacy Policy.

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute. We encourage you to contact us first so we can try to resolve any issue directly.

We may update these terms as the Service develops; the “last updated” date shows when they last changed, and continued use after a change means you accept it.
